When CaptionCall launched in 2011, they offered the CaptionCall phone free to eligible users. Captel, Hamilton Captel and Sprint Captel lobbied the Federal Communications Commission (FCC) to require individuals to pay at least $75 for a captioned phone to qualify for the service. Historically, they all charged $200-$595 for their captioned phones. The FCC adopted this rule in August of 2014.
CaptionCall, filed a Stay Request in the D.C. Circuit Court of Appeals, arguing this FCC regulation requiring a charge for captioned phones violates the rights of people with hearing loss as guaranteed by the American's with Disabilities Act. The Court agreed with CaptionCall and eliminated the rule that customers must pay $75 to qualify. CaptionCall continues to provide the CaptionCall phone, service, in-home setup and education as well as ongoing service at no cost to all eligible people.
